Practice Description
- Mr. Harger’s primary practice is aviation litigation representing defendants. He has been lead counsel on many lawsuits involving multiple deaths, serious personal injuries and property damage resulting from crashes and accidents involving all types of aircraft and aviation products, from jets to parachutes. His representation includes pilots, aircraft owners, fixed-based operators, maintenance faculties and manufacturers.
- He also represents insureds, insurers and self-insured accounts relating to all phases and aspects of aviation litigation, routinely handling claims ranging from millions of dollars to a few thousand dollars.
- Prior to entering the practice of law, Mr. Harger was a professional pilot and aircraft mechanic. He holds an Airline Transport Pilot rating with jet type ratings and thousands of hours of flight experience, as well as Airframe and Powerplant ratings. Mr. Harger routinely handles cases involving pilot error, FAR part 91 and 135 flight operations, pilot training, airport operations and aviation maintenance issues. He is familiar with most aspects of aircraft maintenance, operations and procedures. His knowledge of meteorology has been useful in a number of cases. He is very familiar with corporate, charter, and general aviation operations and procedures, including international flight operations.
- He has extensive experience in premises liability litigation, primary to airports.
- Mr. Harger also participates in litigation and arbitration involving commercial disputes, contract disputes, product liability claims, third party claims, negligence, gross negligence, misrepresentation, breach of warranty, deceptive trade practices, wrongful death, and contribution and indemnity cases.
- His representation of insurance companies includes bad faith, agent issues and problems, and defense of insurers in first party claims. He works with insurance adjusters on a daily basis.
